When companies invest more in documenting compliance than in actually protecting data, when individuals have rights they cannot practically exercise, when regulators have authority they cannot practically deploy, and when the gap between law on paper and law in practice remains vast despite years of implementation, has legislation failed to protect privacy, succeeded in establishing foundation that further development can build upon, or demonstrated that law cannot govern practices it struggles to see, understand, and reach? And if the aspiration is privacy protection that actually constrains surveillance rather than merely documenting it, if achieving that aspiration requires enforcement capacity that does not exist and perhaps cannot exist at scale sufficient to match the problem, if consent models cannot work when people interact with hundreds of data-processing entities, and if fundamental business models that depend on surveillance will resist regulation that threatens them, what legislative approach might actually protect privacy, whether such approach is politically achievable, and whether the choice is between imperfect legislation that provides partial protection and no legislation that provides none, or whether alternatives exist that current frameworks have not yet imagined?
